Welcome to Sit & Stay. These Terms of Service ("Terms") govern your access to and use of our platform, services, and applications. By accessing or using Sit & Stay, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

2. Eligibility

You must be at least 18 years old to use Sit & Stay. By using our platform, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into a binding agreement
• You will provide accurate and complete information
• You will maintain the security of your account credentials

3. User Accounts

3.1 Account Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Services

4.1 Platform Services

Sit & Stay provides a platform connecting pet owners with pet sitters. We facilitate the connection between users but are not a party to the actual pet care arrangements.

4.2 Pet Owner Responsibilities

As a pet owner, you agree to:

• Provide accurate information about your pet(s)
• Disclose any behavioral issues or medical conditions
• Ensure your pet is properly vaccinated
• Provide necessary supplies for your pet's care
• Pay agreed-upon fees in a timely manner

4.3 Pet Sitter Responsibilities

As a pet sitter, you agree to:

• Provide accurate information about your qualifications and experience
• Complete our verification process
• Provide services as agreed with pet owners
• Maintain appropriate insurance coverage
• Report any incidents or emergencies immediately

5. Payments and Fees

5.1 Service Fees

Sit & Stay charges a service fee for facilitating connections between pet owners and sitters. All fees are clearly displayed before booking confirmation.

5.2 Payment Processing

Payments are processed through our secure third-party payment providers. You agree to comply with their terms and conditions.

5.3 Cancellation and Refunds

Cancellation policies vary by sitter. Refunds are subject to the specific cancellation policy agreed upon at the time of booking.

6. Background Checks and Verification

While we conduct background checks on pet sitters, we cannot guarantee the accuracy or completeness of such checks. Pet owners are encouraged to conduct their own due diligence.

7. Prohibited Conduct

You agree not to:

• Violate any applicable laws or regulations
• Provide false or misleading information
• Harass, abuse, or harm other users
• Circumvent our payment system
• Attempt to gain unauthorized access to our systems
• Use the platform for any commercial purpose not authorized by us

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SIT & STAY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

We are not responsible for:

• The conduct of pet owners or pet sitters
• The quality of services provided by pet sitters
• Any injuries, damages, or losses arising from pet care arrangements
• Disputes between pet owners and pet sitters

9. Indemnification

You agree to indemnify, defend, and hold harmless Sit & Stay and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of our services or violation of these Terms.

10. Dispute Resolution

Any disputes arising out of or relating to these Terms shall be resolved through binding arbitration in accordance with the Indian Arbitration and Conciliation Act, 1996.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through our platform. Your continued use of Sit & Stay after such modifications constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
